Germany rejected Belarusian request for extradition |

The Supreme Court of the Federal Land of Pfalz rejected
a request of the Belarusian authorities regarding extradition of a Belarusian fugitive.
The
fugitive, considered by the Belarusian authorities as a criminal offender,
escaped
Belarus and was
hiding from the persecution in
Germany,
the “Radio Liberty” reported referring to the German press.
In
the course of the court hearing, judges considered it unacceptable to refer the
fugitive back to
Belarus
where the basic rights and freedoms were violated and therefore the court made a
decision to release the Belarusian from custody immediately.
German
law prohibits the media to reveal the name of the Belarusian citizen and to report
about the details of the trial. In the meantime, the majority of the press
provided with comments made by judges regarding the verdict.
Rhein
Zeitung reported that the German court questioned the existing legal principles
of the Belarusian state related to fair trial and conditions of imprisonment. Judges
also said that
Belarus
could not guarantee the implementation of the principles declared by the
European Charter on human rights. Based on the principles of the international
law, no German court in this case could agree with the possible violations of
the human rights.
